The former POTUS lost his third bid in two days to keep January 6 records from investigators.

If you’ve been living under a rock or in a medically induced coma for the last year and change, something you may not be aware of is that we have a new president named Joe Biden. Yes, in November 2020, the former V.P. beat Donald Trump at the ballot box, and two months later, following a brief interruption in which the U.S. Capitol was attacked, that Joe fella was inaugurated and officially became our 46th POTUS. Obviously, most people lived through these events, and they will not come as a surprise. One person still struggling to accept that they happened? One Donald Trump.

Does Trump literally believe that he himself is still living in the White House, pressing his Diet Coke button, and yelling at bottles of Miracle-Gro in the Rose Garden tool shed? No, we do not have evidence that even he is that far gone (yet). But he does think that he retains the power of the presidency, despite having been fired from the job last year, and the reason we know this is because he keeps yelling about executive privilege, despite no longer being the executive in question, in an attempt to block Congress from obtaining information concerning his activities in the days before, during, and after the January 6 insurrection. And in the way we imagine you’d have to deal with a delusional person repeatedly insisting they’re the Queen of England while trying to bum-rush the guards at Buckingham Palace, a federal judge has basically been forced to slap him across the face and scream, “Snap out of it!”

For the third time in two days, a federal judge has shot down former president Donald Trump’s effort to block January 6 investigators from accessing his White House records. U.S. District Court Judge Tanya Chutkan said in a ruling late Wednesday that she would refuse to stay her own decision—just one day earlier—denying Trump’s request for an injunction that would block the House’s January 6 select committee from gaining access to some of his White House papers. Chutkan, an appointee of President Barack Obama, sharply rejected Trump’s attempt to assert executive privilege over the documents, contending that the decision by the sitting president, Joe Biden, to release them carried greater weight under existing legal precedents.

In her latest decision, the judge said her earlier rationale dictated that she should turn down Trump’s request for a temporary order preventing disclosure of the records pending further legal action. “This court will not effectively ignore its own reasoning in denying injunctive relief in the first place to grant injunctive relief now,” Chutkan wrote. The National Archives, which houses Trump’s records, intends to provide a small initial tranche to congressional investigators on Friday afternoon.

In her 39-page ruling issued on Tuesday, which was the second time she shot down Trump’s request, Chutkan wrote that as a former president, he has exactly zero power to overrule the actual president on issues of executive privilege (Joe Biden has said on two separate occasions that the January 6 committee could access the records it requested). “Presidents are not kings, and Plaintiff is not President,” Chutkan said, a line that no doubt stung considering Trump clearly views himself as king of the world.

In related news, on Wednesday, CNN reported that the House select committee has become interested in gathering information from five former members of Mike Pence’s inner circle, including former national security adviser Keith Kellogg, who was subpoenaed by the committee on Tuesday and was reportedly with Trump for much of the day on January 6. And apparently at least some of the ex-V.P.’s advisers are more than willing to spill:

Multiple sources tell CNN that some individuals close to Pence may be willing, either voluntarily or under the guise of a “friendly subpoena,” to provide critical information on how Trump and his allies tried to pressure the former vice president to overturn the results of the 2020 election. According to sources familiar with the discussions, some Pence aides are proving more willing to engage with the committee than previously made public.

On Tuesday, The New York Times reported that the January 6 committee has interviewed more than 150 witnesses, “some of whom surprised investigators by proactively contacting the committee to testify, according to two people familiar with the investigation.”
