A 25-year-old man previously cited by the California Highway Patrol on suspicion of reckless driving on Interstate 80 after he was seen in the backseat of his Tesla late last month was in county jail Tuesday after his arrest a day earlier on suspicion of a similar incident, authorities said.

In a statement Tuesday, the CHP said officers responded shortly before 6:35 p.m. Monday after dispatchers received calls about a person seen sitting in the backseat of a Tesla Model 3 with no one in the driver’s seat heading eastbound on I-80 across the Oakland-San Francisco Bay Bridge toward Oakland.

At the bridge toll plaza, a CHP motor officer found the Tesla and began an enforcement stop after seeing a lone person in the car’s backseat. Soon after, the officer saw the person move from the backseat to the driver’s seat. The car came to a stop alongside eastbound I-80 lanes west of Powell Street, the CHP said.

Officers arrested the car occupant and booked him into Santa Rita Jail on suspicion of reckless driving and disobeying a peace officer. The car was towed from the scene as evidence, the CHP said.

According to an county records check, he was listed in custody Tuesday night under an temporary emergency citation.

The CHP said the man had been previously cited April 27 after a similar incident, after officers received third-hand information of a man in the backseat of the dark four-door sedan as it apparently drives either on a city street or freeway section in West Oakland, with Port of Oakland cranes visible in the background.

A second image posted shows the vehicle parked somewhere and the same man grinning in the rear seat.

In a social-media post last Saturday, the CHP said it “has been made aware of an incident involving a man riding in the back seat of a Tesla traveling on Bay Area roadways with no other person being seated in the driver’s seat. The CHP received a report of the incident as third-hand information, and it is under investigation,” the post says. It does not say when the information was received.

The CHP had asked that anyone who sees “an unusual incident such as this one” to immediately call 911 with as many details as possible.

It is illegal in California for autonomous vehicles to operate without humans behind the wheel.

A commenter who said they owned a Tesla said it was impossible to operate the car in full self-driving mode without someone in the driver’s seat and sensors checking for hands on the steering wheel.

But some posters responded that a consumer magazine had recently reported that a Tesla could be tricked into thinking there was someone behind the wheel.

A few commenters questioned whether the driverless journey was a joke, claiming a hand or foot from someone crouched down in the front portion could be seen on the steering wheel.

And one commenter who said he owned a Tesla said “It’s people like him ruining it for the rest of us. Lock his rear up.”
